Who are we:

  • ShareForce Limited is a staffing solutions company who for the purposes of the Data Protection Act 1998, the General Data Protection Regulations and any subsequent data protection legislation, is the data controller.

What is our lawful basis for processing personal data:

  • Our lawful basis for processing your personal data is our legitimate business interests. As a staffing solutions company our focus is to provide candidates with the most suitable job role to help them progress their career and provide our clients with the best candidates to allow them to further their success.
  • To carry out both objectives we require a database of personal data from both our clients and our candidates.  We will also rely on contract as our lawful basis if we are in the process of setting up or have already set up a contract with you or your organisation. This includes our employees, and specifically includes processing of right to work documentation & financial details.
  • We will on some occasions rely on consent as our lawful basis to handle your personal data, in this case we will ask for your explicit consent before processing your data any further.  Most often this will be when we wish to introduce you, as a candidate, to a client. If we require your consent this will be requested by email or orally, the response to which will be recorded on our system, however if you should change your mind your consent to this process can be withdrawn at any time.
  • We also have a legal obligation to process your personal data in some instances. For example, we are required by law to keep any employee, contractor and placement data for a minimum of 6 years for purposes such as taxation.

What personal data do we collect:

  • All the information we collect about you will come either from filling in forms on our website or through correspondence with yourself, such as by email, phone or via social media such as LinkedIn.  We may also receive information about yourself from any job boards you have registered for or if you apply for any of the roles we have available through job sites.
  • The information collected may include your name, address, contact details (email and phone numbers) and your CV.
  • If your CV is provided to us there will be additional personal information such as your work history, qualifications, skill set, nationality, salary expectations and current employment details that we will collect, we may also require your financial details (if you become a contractor or employee for us), a copy of your passport or documentation to prove your right to work in the United Kingdom.We use the personal data mentioned above purely to assess your suitability for the roles we have available and w
  • We only collect what is necessary to do so. You do not have to provide us with the information we ask for however it may affect your application if you do not.
  • Technical information is also collected when you access our website, this is used purely to provide an overview of how our website is being used and to make any necessary improvements which will ensure the best experience for you when browsing our website. This can include your IP address, operating system, browser type and any download errors.

What do we do with the personal data we collect:  

  • Any personal data we collect is used purely to provide you with recruitment services, ultimately, we use your personal details to match you with the right role within the right company. Your personal data is only shared with potential employers after we have received your consent to do so and we do not send out any marketing emails or texts.
  • We store your personal data through third party services including cloud services, this ensures that none of your personal data is kept on our hard drives or in physical form which minimizes the risk of any data being lost or breached.
  • We may also be required to disclose your personal data due to legal obligations such as accounting and taxation purposes. 

How long do we keep personal data for:

  • Any personal data we receive shall be kept for the length of your professional career, provided we have not received a request to have the data removed from our system. We believe that long term relationships with both our candidates and clients is an important part of how we work and why we have such great success placing the right candidates in the right roles. 

What are your rights?

  • Access to your data: You have the right to request access to any personal data we may hold on you, this includes receiving a copy of all the data we hold as well as being informed of the purposes of us processing the data and where we collected the data from. This data must be provided to you within 1 month of your request. 
  • Rectification of data: You have the right to request that any inaccurate personal data relating to yourself within our records is rectified and updated with undue delay. 
  • Right to be forgotten: You have the right to request that we delete your personal data from our records and that we no longer have contact with you.
  • Restriction of processing: You have the right to restrict the way in which we are processing your personal data. 
  • Objection to processing:  You have the right to request that we stop processing your personal data in a certain way, for example no longer receiving direct marketing, on the basis of your individual situation.
  • Data Portability:  You have the right to obtain a copy of the personal data we hold on you in a format which is common and easy to use so that you can transfer this data to another data controller. 
  • Automated decision making & profiling:  You have the right to object to any substantial decisions being made exclusively by automated means. This also includes the right to request a human looks over the automated decisions that have been made.
  • Right to compensation:  You have the right to claim compensations for any damages that are caused by the violation of any data protection regulations from either the data controller or data processor. 
  • How can you make a complaint:  If you feel we have breached our privacy policy or that our policy does not meet the required regulations you have the right to issue a complaint with ShareForce Limited. If you feel your complaint requires further consideration you also have the right to complain to the Information Commissioners Office (http://ico.org.uk/concerns/).
